Why he might be annoying:

    He has been convicted of illegal spam activities under a Virginia law.
    The third defendant Richard Rutkowski, was acquitted. Rutkowski owned the domain names and IP addresses used.
    He used fake IP address.
    He sold non-existent products.
    He sold an 'earn money at home' product that did not exist, called 'the FedEx refund processor.'
    On one day, he sent 7.7 million messages to AOL subscribers.
    His violation was using 'fraudulent and untraceable routing information.'
    Prosecutor Russell McGuire said: 'He's been successful ripping people off all these years.'
    He used the alias Gaven Stubberfield.
    Spamhaus labeled him the eighth-most prolific spammer in the world when he was arrested (December 2003).
    Virginia argued that they had thousands of IP addresses and a list of millions of e-mail addresses.
    The state argued that if the addresses were solicited, then 75% of the e-mails would not have bounced.
    Although they live in North Carolina, they were tried in Virginia under Virginia laws because they used AOL, headquartered in Virginia.

Why he might not be annoying:

    Attorney General Jerry W. Kilgore said about the conviction: 'This is a major victory for Virginians and all Americans.'
    He was arrested (December 2003).
    His sister Jessica DeGroot, 28, was fined $7,500.
    He was found guilty despite not presenting a single witness who was spammed.
    He received 10,000 credit card orders at $39.95 in just a single month.
    He and his sister made $24 million from their e-mail scams.
    Virginia state law forbids using fake addresses to send bulk e-mails.
    He is the first spammer to be sentenced to jail time.
    He was sentenced to nine years (November 3, 2004), but formal sentencing is for February 2005.
